Luther was sentenced in Waco, Texas for possession of narcotics and was received at Leavenworth Prison on December 15, 1934. He died from an acute heart failure on May 3, 1935 and was buried the United States Penitentiary Cemetery, Leavenworth in Row 3, Grave 36.
